Inadmissibility of judicial act

The General assembly of the Civil and Commercial Divisions of the Supreme Court of Cassation and First and Second Divisions of the Supreme Administrative Court have ruled in an interpretative decree № 1/2016, stating that when a judicial act is rendered by an incompetent court according to the rules of jurisdiction alloting cases between Civil and Administrative courts, the act is inadmissible, but not void. The decision was signed with dissenting opinion by five judges.
